End User License Agreement (EULA)
1. Acceptance of Terms
By using the Music Birthday application (the "Application"), you agree to be bound by the terms of this End User License Agreement ("EULA"). If you do not agree to these terms, do not use the Application.
2. User Requirements
You must be at least 13 years of age to use the Application. You agree to maintain the confidentiality of your account credentials and only use the Application for lawful purposes
3. Authentication and Data Collection
The Application exclusively uses Spotify OAUTH for authentication and user access. By using the Application, you consent to the collection and processing of:
- Email address (if designated during account creation)
- Spotify account metadata
- Location information (country code level only)
- Spotify account details (premium status, profile picture, and number of followers)
- Recently listened tracks and artists
4. Data Usage and Privacy
We will use your data to provide Application functionality, improve user experience, and if needed to comply with legal obligations. We will not share identifiable information without your consent or disclose your data for marketing purposes without explicit permission
5. Intellectual Property
The Application and all associated intellectual property rights are owned by Music Birthday, LLC. You may not reverse engineer the Application, create derivative works, or remove or alter any proprietary notices
6. Warranty DISCLAIMER
THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSIC BIRTHDAY, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION.
8. Termination
We may terminate your license at any time if you breach this EULA. If for some reason you want to remove Music Birthday's permissions to generate your Music Birthday playlist, you can do so by following the instructions here
9. Changes to EULA
We reserve the right to modify this EULA at any time. Continued use of the Application after changes constitutes acceptance of the new terms.
